1. Appointment
1.1. Event Genius is to act as an online agent for the sale of tickets appointed and authorised by the Event Organiser
2. The sale of tickets
2.1. The Event Genius booking fee, handling fee and any other fee charged associated to process and deliver the tickets to the customer will be paid by the customer and be retained by Event Genius unless otherwise agreed. Event Genius will also charge the customer for the face value of the tickets.
2.2. The booking fee charged to customers is typically 10% of the face value if above £10 and £1 if the face value is under £10 however we reserve the right to adjust this on a per event basis or per ticket basis.
3. Physical Tickets, E-Tickets and mobile tickets
3.1. Event Genius has three different ticket delivery methods. Barcoded email and SMS tickets or physical paper ticket delivery through postal services. It is the Event Organisers responsibility to select the appropriate method of delivery for their event and have sufficient means of checking the validity of each ticket.
3.2. If physical ticket stock is sold on Event Genius, the final day for distribution will be 5 working days before an event. Event Genius will then distribute email and mobile Tickets for the event, or tickets will go off sale entirely. Event Genius may suspend any delivery method if it deems that the service may be affected by events beyond our control.
3.3. Event Genius may place advertising content on e-tickets, mobile tickets or in physical stock delivery envelopes. The income generated from such activity will belong to Event Genius only.
3.4. Event Genius provides live sales data and reports available online in each event organisers members area available 24/7, 365 days a year. It is the event organisers sole responsibility to manage their event and control their stock through our online control panel.
3.5. All ticket sales are final, and Event Genius will not offer any refunds. Refunds will only be granted if the event is postponed or cancelled. The event organiser must give us written notice in order for Event Genius to proceed with any action. All refunds will be for the face value of the tickets and will not include any booking fees or handling fees. In other cases where a refund may be granted is if Event Genius acknowledged a failure with the service.
3.6. In the case of an event being cancelled Event Genius will notify customers and will endeavour to refund customers. Event Genius will only refund customers if the customers' monies have not yet been transferred to the event organiser. Event Genius has no obligation to refund the customer if the monies have already been transferred. Once the customers monies have been transferred it is the responsibility of the Event Organiser to provide the customer with a refund. If monies are transferred back to Event Genius only then will Event Genius provide the customer a refund.
3.7. Event Genius will always keep all tickets in their possession as what they deem safe with the aim to prevent any incident such as loss, theft or damage. However, Event Genius will not be held responsible if any of the mentioned incidents occur. The Event Organiser will be contacted immediately with full records in the case of an incident.
4. Receipt of funds
4.1. Event Genius will collect the face value of the ticket on behalf of the event organiser. All the funds collected will in turn be remitted to the event organiser within 2 business days of the event. The funds are then transferred to a nominated bank account by the event organiser.
4.2. It is the Event Organisers responsibility to ensure Event Genius has the most up to date and valid payment details on their account. If payment details are incorrect Event Genius will not will be held responsible nor will they be liable. Any change in payment details must be made by the event organiser directly onto the ticketing platform, or the Event Genius team must be notified at least 10 days before the funds are due to be transferred in writing on company letter headed paper.
4.3. In the case that the Event Organiser has outstanding debts such as chargebacks or any other services provided, Event Genius reserve the right to withhold all ticket remittance until said debts are paid and cleared in full.
4.4. Event Genius will aim to prevent chargeback’s by having anti-fraud checks and screening systems in place to help identify fraudulent transactions. Event Genius will work with Event Organisers to challenge any chargeback claims encountered.
4.5. If a chargeback claim results in a successful claim for the consumer, then the Event Organiser will be liable and will indemnify Event Genius against all losses resulting from the case. In the case of a chargeback occurring Event Genius will raise an invoice to the promoter and will require payment within 3 working days. If Event Genius has ticket monies due to be transferred over to the event organiser, Event Genius reserves the right to withdraw the chargeback funds from this amount. Any unpaid invoices to Event Genius may result in ticket monies not being transferred to the Event Organiser.
5. VAT and Taxes
5.1. Event Genius is not responsible for any account or payment of VAT or other taxes on the face value of any ticket sales sold through any of it sales channels.
6. General Terms
6.1. When using the Event Genius service, the Event Organiser shall include Event Genius’ official logo's and URL on all advertising material. The Event Organiser shall not alter any logos in anyway unless approval is given.
6.2. Event Genius is not responsible for the methods of advertising used by an Event Organiser. The Event Organiser will indemnify Event Genius against any costs/fines/losses incurred if any illegal methods have been used.
6.3. By agreeing to our terms and conditions you agree to be contacted from time to time with newsletters and other promotional offers.
6.4. It is the Event Organisers sole responsibility for checking that all their content is correct and up to date.
6.5. This agreement shall be governed and construed according to the law of England and Wales.
